Judge Wilken, asking about the settlement being intended to cover the next ten years, affecting hundreds of thousands of people in the future who are not yet in college: “Can you have a class of future people who aren’t known yet? ... Can they be understood to release claims for things that haven’t happened yet?" 

A little later she asked: "Is that the death knell?"
