If they have factored it in, why isn't it paid? Forcing Cincy to take them to court over this is bananas.

Texas Tech is not named as a defendant in the suit and is not legally required to pay Cincinnati directly.  Sorsby's representatives, however have stated he refuses to pay and plan to defend the lawsuit aggressively, calling the buyout an unlawful penalty.

Why do these kids’ “representatives” think legally binding contracts aren’t enforceable?   So important for schools like Cincinnati to pursue contract enforcement aggressively.

Darian Mensah's case provides a blueprint for how the players' representatives have actively sought to avoid paying full contract buyouts.  Both sides had too much to lose by going to court.  They will likely shift to a settlement strategy to avoid a final stage trial.

I was coming to post the same thing. You're going to see more schools do this unless the framework changes. These players have to understand this free for all won't last forever.

Sorsby signed a contract and breached it. Now he gets to deal with the consequences. Wouldn't surprise me to see someone cover the settled amount (as someone stated above).

At least part of the problem is the contracts the players are signing tend to be onerous and read more like employment agreements rather than NIL deals. That leaves enough wiggle room for lawyers to leverage the situation.

They could potentially go after Texas Tech for tortuous interference if they induced him to break the contract. Now you’re talking big money.
