  3. This is rookie level stuff. The LB from Florida ended up at Ole Miss I think flipped 6 or 7 times. Izaiah something. i think there was a DB last cycle that flipped between Auburn and Bama 5 times.

  7. The judge granting the temporary injunction is what set the wheels in motion. When he did, Tech was emboldened and didnt consider the consequences. Truth be told as a competitive person it has happened to me many times where I thought the victory was worth the cost. Frankly the Big 12s lawsuit was the ultimate reality check. A number of people at tech (or Kessler) read the lawsuit and the tea leaves and made an adult decision. in the famous words of Mike Tyson, “Everyone has a plan until they get punched in the mouth.”
  8. One interesting thing about the judge is she was originally nominated to the federal bench by Obama but her nomination expired. Then she was renominated by Trump. She was a respected litigator before she took the bench. The lawyer representing the Big 12 is a BYU graduate who represented the Big 12 in thr House settlement and litigation. Should be a fun case to monitor as there won’t be a lot of gamesmanship in federal court.

  10. I’ll pull the case on pacer later today and see who it got assigned to. Tech Law is not known for putting many judges on the federal bench. I would be surprised if there are any federal appellate judges who graduated from Tech Law. It is a lower level law school, just above Texas Southern and maybe on same level as St Marys or South Texas. Don’t mean to offend anyone who went to those schools.
  11. When Texas Tech joined the Big 12, they agreed to abide by its rules—so it always seemed crazy to me that Cody Campbell would say you can’t punish us for that because that would be collusion. Well hell yes it is collusion, but its a collusion Tech agreed to allow happen.

  16. Usually judges rule from the bench on a TRO on whether the plaintiff has a substantial likelihood of success. After that they move to a preliminary injunction phase where witnesses can testify. That has to be held 14 days after the TRO is granted. If its not granted, that usually means the judge is not going to grant the injunction.
  17. This is not in federal court. It is in Lubbock County court. Fifth Circuit court of appeals hears federal appeals and the Texas appellate courts hear Texas appeals.
  18. My wife who hates basketball has started watching because of Wemby. If he stays healthy he can be the next Jordan as far as viewers go. He is likable and unreal to watch. It doesnt make sense how he is able to move at that size.
  19. Apparently he was paying other people to make bets for him—which is evidence he knew it was wrong—and was under the legal age in Indiana when he made the bets. So the people who made the bets could be responsible also. Betting on your team can also be illegal if it involves score fixing. Some Arizona basketball players went to prison for the point shaving part of it and conspiracy to fix the outcome. Not saying that is involved, but the magnitude of his bets on his own team just look terrible. There has to be a consequence for him betting on his team for the sake of the integrity of the game. Not getting to play College sports seems like a slap on the wrist as a penalty.

One of the things that judges will have to deal with in granting an injunction is the balance between protecting someone’s right (to play college football here) versus the harm to the public interest (reputation of the sport). There is no way a judge SHOULD grant this young man an injunction. It was probably a bad idea to seek one as well as it has now revealed the extent of his problems and likely opened him up to criminal liability. Will be interesting to see the positions his lawyers take publicly given their ethical responsibilities to the court and duty of candor.
  21. As a trial lawyer, he speaks for people who can’t speak for themselves. If he sponsors the website—great. He is not on here making political statements. He is making those statements on his public account. This is a free country and he is exercising his rights. If you disagree with his views that is also what makes America great. Censoring someones views because you don’t agree with them, or trying to get them removed as a sponsor is what is starting to make our country not so great. Try to find some common ground with his viewpoints and understand them—maybe your passion for the Longhorns can be the start of that journey.
  22. I think this evaluation is low and once Muschamp utilizes Giffridge/Kanu/Sharma, Justus Terry, Lance Jackson others at DT /3 tech/DE and you put Simmons dedicated rush—we will be dominant. Getting healthy Vasek and Zina we will be scary. Lance Jackson showed up as a true freshman and made plays last year. I’m more excited about our defense next year than our offense.
  23. One other thing. The stupid sideline questions for the coaches like “what is your team going to have to do to win” are ridiculous.
